Our Constitution

1. Name

The name of the Charitable Incorporated/registered Organization is “Tahirkheli Express”

3. Objective[s]

The objective of the charity is to collect funds from Tahirkheli families and distribute to Tahirkheli families those are under privileged and can’t effort education be starting from elementary level to professional colleges.

3.1. The advancement of education by the provision of cash assistance or in shape of books, uniforms, & all other necessary accessories needing for a student to continue his studies or sponsorship to enable children to attend school and by such other means as the trustees may determine.

3.2. The prevention or relief of poverty by providing or assisting in the provision of education, technical education/training, skill enhancing courses/training or education and all the necessary support designed to enable individuals to generate a sustainable income and be self-reliant.

4. Criteria for Selecting a beneficiary

An application will be submitted by a beneficiary with all the required documentation and will be reviewed by committee members and may ask for further documentation, once satisfied committee will decide on approval and how much fund should be distributed.

4.1 Family Criteria

4.1.1    Rule of thumb for selecting a beneficiary is that his/her father or mother should be a Tahirkheli living in Kahri/Ganger/Haro jurisdiction. If any confusion, committee members will decide.

4.1.2    If Committee members in majority suggest or decide to extend aid or sponsorship to the children of Tahirkheli mother who got married to a non Tahirkheli husband can be considered.

4.2 Merit Criteria

4.2.1    The beneficiary is an orphan or underprivileged, to be reviewed by committee members and decide.

4.2.2   Poor Parents can’t afford to peruse the studies, committee members to review and decide

4.2.3    Shinning / Brilliant Academic record, one who deserve and one who qualify, committee members to review credentials and decide

4.2.4    Beneficiary is willing to continue studies, committee members to review and decide

4.2.5    Minimum requirement to start the Scholarship or Aid should be from elementary level

4.2.6    The maximum age limit of the beneficiary is 30, to be verified on ID card and birth certificate.

5. Charity Trustees

Four members of the committee are trustees of the charity and have control of the association, its property and funds. Following four trustees are permanent member of Tahirkheli Express. And there are 6 more committee member and they will be appointed for three years. After three years Trustees of the committee will review the performance of the member and based on that, term will be extended for next three years or will be expired. Four trustees will vote on approval process for committee member for three-year period. If there is need to review the performance of any member before three years on the request of four trustees, then it must be reviewed and delivered to a member committee. If needed trustees can expire the three-year term and replace that member.

6. Members’ decisions

A charity trustee must:

6.1 Apart from four charity trustees, every committee member must be appointed [for a term of three years] by a resolution passed at a properly convened meeting of the charity trustees.

6.2 In selecting individuals for appointment as committee member, the member must have regard to the skills, knowledge and experience needed for the effective administration of the TAHIRKHELI EXPRESS

7. Meetings of charity trustees

If the TAHIRKHELI EXPRESS wound up, the members of the TAHIRKHELI EXPRESS have no liability to contribute to its assets and no personal responsibility for settling its debts and liabilities.

7.1       Calling meetings

7.1.1    Any charity trustee/member may call a meeting of the committee members

7.1.2    Subject to that, the charity trustees/members shall decide how their meetings are to be called, and what notice is required.

7.2       Chairing of meetings
The charity trustees may appoint one of their committee number to chair their meetings and may at any time revoke such appointment. If no-one has been so appointed, or if the person appointed is unwilling to preside or is not present within 10 minutes after the time of the meeting, the charity trustees present may appoint one of their number to chair that meeting.

7.3       Procedure at meetings

7.3.1    A decision can be taken at a meeting if maximum numbers of committee members are present

7.3.2    Questions arising at a meeting shall be decided by a majority of those eligible to vote.

7.3.3  In the case of an equality of votes, the person who chairs the meeting shall have a second or casting vote.

7.4       Participation in meetings by electronic means

7.4.1    A meeting may be held by suitable electronic means agreed by the charity trustees in which each participant may communicate with all the other participants.

7.4.2    Any committee member participating at a meeting by suitable electronic means agreed by the charity trustees in which a participant or participants may communicate with all the other participants shall qualify as being present at the meeting.

7.4.3    Meetings held by electronic means must comply with rules for meetings, including chairing and the taking of minutes

8. Membership of the TAHIRKHELI EXPRESS

8.1       The committee members of the TAHIRKHELI EXPRESS shall provide the membership for Tahirkheli Express Group on facebook after reviewing the criteria for membership that is set at that time.

9. Informal or associate (non-voting) membership

9.1       The charity trustees may create associate or other classes of non-voting membership, for example advisors, investigator or accountant etc.; when and where it is needed and may determine the rights and obligations of any such members.

10. Execution of documents

10.1     The TAHIRKHELI EXPRESS shall execute documents either by signature or by affixing its seal (if it has one)

10.2     A document is validly executed by signature if it is signed by at least two of the committee members

11. Minutes

The charity trustees must keep minutes of all:

11.1     appointments of officers made by the charity trustee;

11.2     proceedings at routine biweekly & general meetings of the TAHIRKHELI EXPRESS

11.3     meetings of the charity trustees and committees of charity trustees including: • the names of the trustees present at the meeting;

11.3.1  the decisions made at the meetings; and

11.3.2  where appropriate the reasons for the decisions;

11.3.3  decisions made by the committee members otherwise than in meetings.

12. Accounting records, accounts, annual reports and returns, register maintenance

12.1     The charity trustees and committee members must comply with the requirements of the Charities Act. about the keeping of accounting records, to the preparation and scrutiny of statements of account, and to the preparation of annual reports and returns. The statements of account, reports and to be submitted with the authority in the specified time frame of the financial year.

12.2     The charity trustees must comply with all requirement that are compulsory as the laid act of the charities

13. Amendment of constitution

13.1 if necessary, constitution can be amended, fulfilling following requirements:

13.1.1  by resolution agreed in writing by all members of the TAHIRKHELI EXPRESS; or

13.1.2  by a resolution passed by a 75% majority of those voting at a general meeting of the members of the TAHIRKHELI EXPRESS called for the subject matter or for ant change in clause

13.1.3  A copy of every resolution amending the constitution, together with a copy of the TAHIRKHELI EXPRESS constitution as amended must be lodge with appropriate authority such as register charities within a specified time.
